FILING OFFICER - All reports required of a candidate shall be filed with the officer before whom the candidate is required by law to qualify. Candidates, except candidates for statewide office, must also file a copy of the entire report with the supervisor of elections in the county in which the candidate resides. Reports required of political committees shall be filed with the agency or officer before whom such committee registers. All committees of continuous existance shall file reports with the Division of Elections and at the same time a duplicate copy of their reports with the supervisor of elections in the county in which the committee maintains its books and records with the exception of committees located in Leon County which need only file with the Division of Elections.
(IMPORTANT NOTE: Rule 1S-2.017, F.A.C. requires that all candidates, political committees and committees of continuous existence, who file with the Department of State must file electronically. Any candidate, political committee, or committee of continuous existence who is unable to file a campaign treasurer's report on magnetic diskette, must file a statement to this effect with the Division of Elections. Thereafter, such reports may be filed in hard copy. An original and duplicate copy of the Campaign Treasurer's Report Summary (Form DS-DE 12), and a magnetic diskette of the information required by Chapter 106, F.S., must be filed with the Division of Elections.)
WAIVER OF REPORTS - In any reporting period when there has been no activity in the account (no funds expended or received) the filing of the required report is waived. HOWEVER, THE FILING OFFICER MUST BE NOTIFIED IN WRITING ON THE PRESCRIBED REPORTING DATE THAT NO REPORT IS BEING FILED. (Section 106.07(7), F.S.)
PENALTY FOR LATE FILING - Any candidate or political committee failing to file a report on the designated due date shall be subject to a fine of $50 per day for the first 3 days late and, thereafter, $500 per day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report. However, for the reports immediately preceding each primary and general election, the fine shall be $500 per day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report.
Any committee of continuous existence failing to file a report on the designated due date shall be subject to a fine of $500 per day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report.
REGISTERED POLITICAL COMMITTEES AND COMMITTEES OF CONTINUOUS EXISTENCE - Registered political committees and committees of continuous existence must file reports on all dates listed below, with the exception of the 90 day termination report. In addition, committees of continuous existence must file an annual report with the Division of Elections during the month of January. (Section 106.04(4)(a), F.S.)
